In this Privacy Policy, 'us' 'we' or 'our' means CAPITAL-e Marketing and Events Pty Ltd, ACN 149 821 465 and our related bodies corporate.  We are committed to respecting your privacy.  Our Privacy Policy sets out how we collect, use, store and disclose your Personal Information. We are bound by the Australian Privacy Principles contained in the Privacy Act. 

By providing personal information to us, you consent to our collection, use and disclosure of your Personal Information in accordance with this Privacy Policy and any other arrangements that apply between us.  We may change our Privacy Policy from time to time by publishing changes to it on our website.  We encourage you to check our website periodically to ensure that you are aware of our current Privacy Policy.

For the purposes of this Privacy Policy:

APPs means the Australian Privacy Principles set out in Schedule 1 of the Privacy Act.

Personal Information has the same meaning given under section 6 of the Privacy Act. For example, this may include your name, age, gender, postcode and contact details.

Privacy Act means the Privacy Act 1988 (Cth).

Sensitive Information has the same meaning given under section 6 of the Privacy Act.

1. What personal information do we collect?

1.1 We may collect the following types of personal information:

  • telephone number and other contact details;

  • age or date of birth;

  • credit card information;

  • your device ID, device type, geo-location information, computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address, browser type and standard web log information;

  • details of the products and services we have provided to you or that you have enquired about, including any additional information necessary to deliver those products and services and respond to your enquiries;

  • any additional information relating to you that you provide to us directly through our website or app or indirectly through your use of our website or app or online presence or through other websites or accounts from which you permit us to collect information;

  • information you provide to us through customer surveys; and/ or

  • any other personal information that may be required in order to facilitate your dealings with us.

  • We may also collect data on how you interact with our website and acquire information through the use of “cookies” delivered to your computer when you access our website, including pages visited, time spent, and preferences, to improve your browsing experience.

1.2 Sensitive Information

  • We may need to collect Sensitive Information about you so that we can provide particular services to you, such as information about your race and ethnic origin, membership of a professional or trade association, membership of a trade union.

  • We will collect the Sensitive Information if we are required or authorised to do so by law, or with your explicit consent and where it is reasonably necessary for or directly related to one or more of performing our functions or activities as set out in clause 4 below.

  • We will not use or disclose Sensitive Information for purposes other than those for which it was collected, unless we subsequently receive your consent to use it otherwise.

2 How do we collect personal information?

2.1 Collection of information

  • We may collect these types of Personal Information either directly from you, or from third parties. You should let us know immediately if you become aware that your personal information has been provided to us by another person without your voluntary consent.

  • We may collect this information when you:

    • register on our website and/ or app;

    • when you visit and/or use this website, or when you visit and comment on any social media accounts that we manage;

    • when you subscribe to receiving marketing and promotional materials from us including e-newsletters or emails;

    • when you participate in or respond to one of our surveys or promotions (please note your attendance on promotions are subject to separate terms and conditions);

    • communicate with us through correspondence, chats, email or make an inquiry via our website (including website enquiry forms), or when you provide feedback to us or share information with us from other social applications, services or websites;

    • in the course of providing services to you via the website, through the telephone and/or emails;

    • interact with our sites, services, content and advertising; or

2.2 Collection of information during employment applications

In addition, when you apply for a job or position with us we may collect certain information from you (including your name, contact details, working history and relevant records checks) from any recruitment consultant, your previous employers and others who may be able to provide information to us to assist in our decision on whether or not to make you an offer of employment or engage you under a contract.  This Privacy Policy does not apply to acts and practices in relation to employee records of our current and former employees, which are exempt from the Privacy Act.

2.3 Third party information collection

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties including law enforcement, government entities, payment service providers, authorised representatives, market research providers, information service and analytics providers such as Google Analytics and referees or previous employers in employment applications. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

3 Consent

  • We do not collect, hold, use or disclose your Personal Information without your consent except where permitted and authorised by law. 

  • By using our services and the website, you hereby consent to us collecting, holding, using, disclosing, transferring, and processing your Personal Information in accordance with this Privacy Policy. 

  • By providing us with your Personal Information through any method, you consent to us using your Personal Information to send you marketing materials via emails, text messages, or mails. 

4 Why do we collect, use and disclose personal information?

4.1 Primary purpose

We may collect, hold, use and disclose your Personal Information to:

  • enable you to access and use our website, services, and/ or app;

  • operate, protect, improve and optimise our website, services and/ or app, business and our users’ experience, such as to perform analytics, conduct research and for advertising and marketing;

  • send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you;

  • send you marketing and promotional messages and other information that may be of interest to you, including information sent by, or on behalf of, our business partners that we think you may find interesting;

  • consider your employment application. 

4.2 Secondary purpose

We may also in certain circumstances use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure.

5 Do we use your personal information for direct marketing?

We and/or our carefully selected business partners may send you direct marketing communications and information about our services and/ or products. The marketing content includes but not limited to our latest events, deals and promotions and invitation to special events.  This may take the form of emails, SMS, mail or other forms of communication, in accordance with the Spam Act and the Privacy Act.  You may opt-out of receiving marketing materials from us by contacting us using the details set out below or by using the opt-out facilities provided (e.g. an unsubscribe link).

6 To whom do we disclose your personal information?

  • We may disclose Personal Information for the purposes described in this Privacy Policy to:

    • our employees and related bodies corporate;

    • third party suppliers and service providers (including providers for the operation of our websites and/or our business or in connection with providing our products and services to you);

    • professional advisers, dealers and agents;

    • payment systems operators (eg merchants receiving card payments); 

    • our existing or potential agents, business partners or partners;

    • our sponsors or promoters of any competition or surveys that we conduct via our services; 

    • anyone to whom our assets or businesses (or any part of them) are or may be transferred;

    • specific third parties authorised by you to receive information held by us; and/ or

    • other persons, including government agencies, regulatory bodies and law enforcement agencies, or as required, authorised or permitted by law.

  • We may also disclose your Personal Information to a trusted third party who also holds other information about you.  This third party may combine that information in order to enable it and us to develop anonymised consumer insights so that we can better understand your preferences and interests, personalise your experience and enhance the products and services that you receive.

  • Please note that we provide the third party with only the Personal Information necessary they need to perform their services and they commit to implement security measures and maintain confidentiality for the Personal Information received. To the extent permitted by the Privacy Act, we will not be liable for how these third-party recipients handle, store, and otherwise process your Personal Information.

7 Disclosure of personal information outside Australia

  • We may disclose your Personal Information outside of Australia to third party suppliers, service providers and/ or cloud providers located in New Zealand, the United States, Asia and elsewhere.

  • We will only disclose your Personal Information to these overseas recipients in connection with the performance of services between you and us and/or to enable the performance of administrative and technical services by them on our behalf.

  • When you provide your personal information to us, you consent to the disclosure of your information outside of Australia or outside of the country where you reside. Unless we have your consent, or an exception under the APPs applies, we will only disclose your Personal Information to overseas recipients where we have taken reasonable steps to ensure that the overseas recipient does not breach the APPs in relation to your Personal Information.

8 Using our website and cookies

  • While we do not use browsing information to identify you personally, we may record certain information about your use of our website, such as which pages you visit, the time and date of your visit and the internet protocol address assigned to your computer. 

  • We may also use 'cookies' or other similar tracking technologies on our website that help us track your website usage and remember your preferences.  Cookies are small files that store information on your computer, TV, mobile phone or other device.  They enable the entity that put the cookie on your device to recognise you across different websites, services, devices and/ or browsing sessions.  You can disable cookies through your internet browser but our website may not work as intended for you if you do so.

  • We may also use cookies to enable us to collect data that may include Personal Information.  For example, where a cookie is linked to your account, it will be considered Personal Information under the Privacy Act.  We will handle any Personal Information collected by cookies in the same way that we handle all other personal information as described in this Privacy Policy. 

9 Security

  • We may hold your Personal Information in either electronic or hard copy form.  

  • We take reasonable steps to protect your Personal Information from misuse, interference and loss, as well as unauthorised access, modification or disclosure. 

  • We use a number of physical, administrative, personnel, technical and organisational measures to protect your Personal Information. For example, we review encryption and security facilities. We hold regular employee trainings on data protection. When disclosing or transferring your Personal Information over the internet, we take all reasonable care to prevent unauthorised access to your Personal Information.

  • Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that Personal Information that we collect will not be disclosed in a manner that is inconsistent with the Privacy Policy. No data transmission over the internet can be guaranteed as fully secure and you acknowledge that you submit information over the internet at your own risk. 

  • We will not retain your Personal Information for any period of time longer than is necessary to serve the purposes set out in this Privacy Policy and any valid business or legal purposes. If we no longer need your Personal Information for any purposes for which the information may be used or disclosed, and unless we are required by law to retain it, we will take reasonable steps in the circumstances to destroy or anonymise any documents containing your Personal Information in a safe and secure manner.

Those links are provided for convenience and may not remain current or be maintained.  Unless expressly stated otherwise, we are not responsible for the privacy practices of, or any content on, those linked websites, and have no control over or rights in those linked websites.  The privacy policies that apply to those other websites may differ substantially from our Privacy Policy, so we encourage individuals to read them before using those websites.

11 Accessing or correcting your personal information

  1. You can access the Personal Information we hold about you by contacting us using the information below in clause 14.  Sometimes, we may not be able to provide you with access to all of your Personal Information and, where this is the case, we will tell you why.  We may also need to verify your identity when you request your Personal Information.

  2. If you think that any Personal Information we hold about you is inaccurate, please contact us and we will take reasonable steps to ensure that it is corrected.

12 Making a complaint

If you think we have breached the Privacy Act, or you wish to make a complaint about the way we have handled your Personal Information, you can contact us using the details set out in clause 14 below.  Please include your name, email address and/ or telephone number and clearly describe your complaint.  We will acknowledge your complaint and respond to you regarding your complaint within a reasonable period of time.  If you are not satisfied with the outcome of your complaint, you may refer the matter to the Office of the Australian Information Commissioner (OAIC):

13 Children

  • This website is directed toward and designed for use by persons aged 16 or older. We do not intend to collect Personal Information from children under 16 years of age, except on some sites specifically directed at children or consent received from the custodians.

  • We protect the Personal Information of children along with the necessary custodian consent in the same manner as we protect the Personal Information of adults.
